The areas of practice below are the ones in which, the partners have been practicing from 2006

Company law

In Rwanda, Company Law has changed considerably. New legislation that governs Companies, commercial recovery and settlement of issues arising from insolvency has been in force since 2009.

 

The law regulating companies is a combination of various provisions including the ones on formation, amalgamation (merger), etc

 

The partners at Advocare have worked on various matters having to do with company law before and after the above changes were introduced in 2009.

 

Organizations

 

In Rwanda, various laws govern the operations of different organizations. For example new laws were enacted regulating religious institutions, cultural institutions, and professional …. IN 2012.

 

The partners at Advocare can help them comply with the new laws either through legal advice or by representation.

 

Civil law

 

The partners at Advocare have experience in both procedure and substantive civil law. In Rwanda, the substantive Civil law is regulated through a Code which is supplemented by legislation on matrimonial regimes, donations and succession.

 

Criminal Law

 

The partners at Advocare have experience in both procedure and substantive criminal law. Recently, changes have been made that have consolidated laws, hitherto scattered across Rwanda’s statute books.
Contract Law

 

Contract Law in Rwanda was partially reviewed in early 2012. The changes have to do with general provisions. The legal provisions on specific contracts are still in force.

Employment & Labor Law

 

The partners at Advocare have worked on various matters having to do with employment and labor law before and after the above changes were introduced in 2009.

 

 

Transportation Law

 

Rwanda has enacted laws that govern land, marine and air transportation.

 

The partners at Advocare have worked on various matters having to do with transportation law. Some of our past work includes work done for airlines and shipping companies.

 

Property Law

 

Immovable property law is covered by a wide array of legislation in Rwanda; however movable property is governed by a single statute. Collaterals and mortgages are regulated by separate laws.

 

The partners at Advocare handle legal matters regarding movable and immovable property, collaterals and mortgages.

 

Intellectual Property Law

 

In Rwanda, Intellectual Property law was enacted in 2009.

 

After its enactment, the law has generated plenty of interest from companies wishing to protect their intellectual property, or be educated about the same. The partners at Advocare have also been involved in working with clients in this area as well.

 

Taxation Law

 

In Rwanda, various laws regulate the area and some legal provisions are out of regional agreements

Administrative Law

 

In the area, before submitting issues to Courts, companies, people … do mostly claim for cancellation of resolutions by the concerned public institutions.

 

Both advocates submitted issues to Courts and handled various legal matters under the area.

 

Banking Law

 

Both advocates provided services to Bank debtors and handled litigations as well.

 

Insurance Law

 

Both advocates provided services to Insured and handled litigations as well.

 

Alternative Dispute Resolution & Litigation

 

Increasingly, clients are beginning to opt for alternative dispute resolution (ADR), especially companies and other institutions. The partners at Advocare also provide alternative dispute resolution. In some cases where ADR has not yielded expected outcomes, they have handled litigation for clients since 2006.
